DISTRICT AND SESSIONS COURT AT AKOLA.
In view of Notification of Home Department bearing No. SRO/1057/5329 (ii)-III, dated 23rd March, 1959 . The Government of Bombay has created Akola Judicial District with effect from the 1st day of April, 1959. Prior to after 1902, as therafer that various enactments were made applicable, berar and Courts were being established. Originally there was only Sessions Judge but letter on Post of District and Sessions Judge, was created at Akola. Hear Berar had two Divisions East Berar and West Berar having two districts each . Akola was the Head Quarter of West Berar comprisig of Akola and Buldhana District. District Judge, Akola had Jurisdiction over Buldhana District. After the bifurcation of Buldhana District, and Akola District the (revenue tahsil) civil courts were established seperately in revenue tahsil, i.e. Akot, Balapur, Washim, Mangrulpir, Murtizapur and Karanja. Appellate Jurisdiction : AKOLA. 1. The Civil appeals against the Judgment and decree and order passed by the Courts of Civil Judge (S.D.) / Civil Judge (J.D.) arrising out of territorial jurisdiction of talukas such as Akola, Murtizapur, Balapur, Patur, Barshitakli shall lie to the District Corut, Akola. 2. The Criminal appeals / Criminal Revisions against the Judgement and order and interlocutory orders respectively, arrising out of the territorial jurisdiction of talukas such as Akola, Murtizapur, Balapur, Patur, Barshitakli shall lie to the Court of Session, Akola. 3. A State Government may, by notification in the official Gazette constitute one or more Motor Accidents Claims Tribunals ( hereafter in this Chapter referred to as Claims Tribunal ) for such area as may be specified in the notification for the purpose of adjucating upon claims for compensation in respect of accidents involving the death of, or bodily injury to, persons arssing out of these of motor vehicles, or damages to any property of a third party so arrising, or both filed before the Motor Accident Claim Tribunal. Akoa. 4. AMENDMENT TO BOMBAY CIVIL COURTS ACT BY BOMBAY CIVIL COURT ( AMENDENT ) ACT, 1998 : SCOPE OF APPLICABILITY OF AMENDMENT BY SECTION 4 OF THE ACT. The Bombay Civil Courts Act, 1869 has been amended by the Bombay Civil Courts ( Amendent ) Act, 1998 which has come into force on 13.01.1999. Section 4 of Amendment Act has amend Section 26 of the Principal Act. The words " Fifty Thousand Ruppes " has been subsituted by the words " Two Lakhs Rupees ". The question, persently engaging the attention of Lawyers is, whether this amendment is retrospecive in nature i.e. It will apply to appeals arrising out of orders and decree passed in suits pending on 13.1.1999, or prospective in nature i.e. It will apply only to orders and decrees passed in suits instituted after 13.1.1999?. The answer to this question depends on whether the suitor has a substantive right to the forum where appeal is to be lodged or it is a matter of procedure. ------------------------------------------------------------------------------ The District Court, Akola.
